Please read these Terms of Service ("Terms") carefully before participating in the VIBE Token presale or using any services provided by VIBE Wellness ("we," "us," or "our"). By accessing our website or participating in the presale, you agree to be bound by these Terms.

2. Nature of VIBE Tokens

VIBE tokens are utility tokens intended to be used within the VIBE ecosystem. They are not securities, investment contracts, or financial instruments. Participation in the presale does not constitute an investment in a business enterprise, and purchasers should not expect profits derived solely from our efforts.

Token purchases are final and non-refundable except where required by applicable law.

3. Eligibility

You are not eligible to participate in the VIBE presale if you are:

• A resident or citizen of the United States of America
• A resident or citizen of any jurisdiction where the purchase or sale of tokens is prohibited by law
• Subject to sanctions administered by any governmental authority
• Under the age of 18 years

By participating, you represent and warrant that you meet all eligibility requirements.

4. Presale Terms

The VIBE Token presale operates across multiple phases. Phase 1 (Seed Sale) tokens are subject to a 60-day lock period followed by a 60-day linear vesting schedule. The token price, hard cap, and vesting terms for each phase are as displayed on our website at the time of purchase.

We reserve the right to modify presale parameters, including pricing and caps, at any time prior to purchase confirmation.

5. Payments

All payments are processed through NOWPayments, a third-party payment processor. We accept USDT (TRC20, ERC20), ETH, and SOL. By making a payment, you agree to NOWPayments' terms of service and acknowledge that all blockchain transactions are irreversible.

Minimum contribution is $20 USD equivalent. We are not responsible for losses due to incorrect wallet addresses, network fees, or transaction errors on your part.

6. Risks

Participating in a token presale involves significant risks, including but not limited to:

• Regulatory changes that may affect the legality or utility of VIBE tokens
• Market volatility and potential loss of value
• Technical risks including smart contract vulnerabilities
• Project development risks and potential delays
• Cybersecurity threats and hacking attempts

You acknowledge that you fully understand these risks and are participating at your own discretion.

7. Intellectual Property

All content on this website, including text, graphics, logos, and software, is the property of VIBE Wellness and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, VIBE Wellness shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your participation in the presale or use of our services. Our total liability shall not exceed the amount you paid in the presale.

9. Indemnification

You agree to indemnify and hold harmless VIBE Wellness, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your violation of these Terms or your participation in the presale.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction where VIBE Wellness is incorporated, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration.
